Latin. Fraud gives rise to no action. A contract founded upon fraud cannot be successfully enforced by the person guilty of the fraud. Any action raised by him to enforce it may be met with the exception stated in the phrase, that fraud gives rise to no action, and that the contract founded upon was a fraud. The person to the contract who was defrauded or overreached may, however, raise action ex capite doll to have the contract reduced. With him rests the option of taking active measures for reduction of the contract, or of meeting any action brought against him upon it, with this exception.
