Latin. From defect of parentage; because of being born out of wedlock; bastardy. Formerly, by our law, bastards who died without lawful issue were incapable of making a testament, and this was said by some to proceed from their defect of parentage; on which It is hard to discover a reason why a disability to test should be one of the consequences of illegitimacy. The disability was removed by the Act 6 Will. IV., cap. 22.
