Consideration is the bargained for exchange that induces current performance and is binding. Valid consideration is created and given concurrently in order to avoid the preexisting duty doctrine. Thus concurrent consideration is an act or a promise which a party to a contract does or makes as a consideration therefor, simultaneously with an act or a promise on the part of the other party which furnishes the consideration to make the exchanges of consideration binding.
