This case determines the construction of age conditions with respect to survivorship. If a gift is made at a designated age, there will be an implied requirement of survivorship by the use of the word 'at'. If a gift is payable at a designated age, there is no implied condition of survivorship. (1) A gift of income vests the principal. (2) A gift at a designated age means that the party will take nothing unless the party survives to that age.
